Welcome to Orbit. These Terms of Service ("Terms") govern your access to and use of Orbit's websites, applications, and other services (collectively, the "Services"). Please read these Terms carefully, as they constitute a legally binding agreement between you and Orbit App Inc. ("Orbit," "we," "us," or "our").

You are responsible for maintaining the security of your account and any associated private keys or seed phrases. Orbit is a non-custodial wallet, which means we do not store, hold, or have access to your funds. You are solely responsible for:

  • Maintaining the confidentiality of your private keys and seed phrases
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

3. Wallet Security

As a non-custodial wallet provider, Orbit does not have access to your private keys or seed phrases. You are solely responsible for:

  • Securing your device and any backup methods
  • Protecting your private keys and seed phrases
  • Understanding the risks associated with cryptocurrency transactions
  • Verifying all transaction details before confirming

4. Risk Disclosure

Cryptocurrency transactions involve significant risks. You acknowledge and agree that:

  • Cryptocurrency values are highly volatile
  • Transactions are generally irreversible
  • You are solely responsible for verifying transaction details
  • We are not responsible for any losses due to market volatility, technical issues, or user error

5. Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose
  • Attempt to gain unauthorized access to the Services
  • Interfere with the proper functioning of the Services
  • Use the Services to facilitate any illegal activities
  • Attempt to reverse engineer or decompile the Services

6. Intellectual Property

The Services and all content, features, and functionality are owned by Orbit or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORBIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to indemnify, defend, and hold harmless Orbit and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Services. Your continued use of the Services after such modifications constitutes your acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Orbit is established, without regard to its conflict of law provisions.

12. Arbitration

Any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the jurisdiction where Orbit is established.
